The legal wrangle is the latest move in the dispute between the network and the regulator which last week issued a "legally binding" directive demanding that the 11 pm bulletin be rescheduled.

The ITC took action because it was unhappy with the 14 per cent drop in audiences after News at Ten was scrapped last year.

The outcome of the review would be a landmark decision, the ITC's power to demand schedule changes having never before been tested in court.
