The World: Copenhagen - Court overturns state aid ruling against TV2

The European Union's Court of First Instance has overturned a decision made by the European Commission in which the Danish television channel TV2/Danmark was ordered to return EUR84 million in state subsidiaries.

In 2004, the Commission found that TV2/Danmark was over-compensated for its public-service programming between 1994 and 2002.

However, the court stated in its ruling that the Commission's decision was "based on an inadequate statement of reasons" and that the conditions "were clearly not adequately examined".

The case could still be appealed to the European Court of Justice within two months by the Commission, as well as by TV2's competitors MTG and SBS, which both brought forward separate cases.
