In 2004, the Commission found that TV2/Danmark was over-compensated for its public-service programming between 1994 and 2002.
However, the court stated in its ruling that the Commission's decision was "based on an inadequate statement of reasons" and that the conditions "were clearly not adequately examined".
The case could still be appealed to the European Court of Justice within two months by the Commission, as well as by TV2's competitors MTG and SBS, which both brought forward separate cases.
