The World: Dallas - Virgin Mobile faces proceedings for use of image

A Dallas family has begun legal proceedings against Virgin Mobile Australia and its US counterpart over their alleged role in the use of their daughter's image in an Australian ad campaign.

The action, filed in a Dallas state district court, accuses the companies of libel and invasion of Alison Chang's privacy, causing her grief and exposing her to ridicule.

The lawsuit follows Virgin Mobile's "Are you with us or what?" campaign, in which the image of the 16-year-old girl, sourced from the Flickr website, was superimposed with two slogans - "Dump your pen friend" and "Free text virgin to virgin".

Virgin Mobile Australia said it was unable to comment because it had not seen a copy of the lawsuit.
