The World: New York - Apple to face legal action over Eminem iPod ad

The footwear manufacturer Lugz has sent a "cease and desist" letter to Apple and its advertising agency, TBWA\Chiat\Day, over perceived similarities between their commercials.

The company maintains that Apple's latest iPod ad featuring Eminem, which uses black silhouettes on a red, yellow and orange background, is the same as its ad, "arrow", which was aired in 2002.

Larry Schwartz, the executive vice-president of the New York-based JSSI, which makes Lugz, said in a statement: "If you look at these spots, common sense would tell you that there's a problem here. The Apple commercial uses the most powerful elements of our campaign, making the ads disturbingly similar. We are prepared to vigorously pursue all legal remedies in order to protect our rights."
